It is critical that patent applicants and owners begin reviewing their patent portfolios and strategize for the upcoming introduction of the Unitary Patent system.

The most recent estimate is that the sunrise period for opting out existing European Patents (EPs) starts on January 1, 2023 and ends on April 1, 2023. EPs which are not opted out during sunrise period risk being forced under the jurisdiction of the Unified Patent Court (UPC) by competitors.

The owner of EPs, that are not opted out, will have the benefit of initiating a central infringement proceeding with effect in all the member states of UPC which the EP is validated in. However, the owner risks having the same EP revoked in these states. There are therefore both advantages and disadvantages with the Unitary Patent system.
